How do I go about starting a business at home?

My sister and I would like to start a business creating gift baskets with decorative soaps, candles, jewelry and possibly chocolate, all hand made, what are the legal steps do we need to take, and do you think something like this would actually fly?

This sounds like a great idea and I definitely think it could fly. You need to create a business plan before you do anything. Even if you don't plan to seek any outside financing it is a smart idea to have a business plan so that you know what you are getting into and can stay on track.

After you have laid out your road map you need to consider what type of business you want to form (LLC, Sole Proprietor, etc.). For your particular case I would recommend staying a Sole Proprietor for now although you might need to be a partnership since your sister is involved.

Reply:First you need to find out what the laws are in your city/county. Next you need to make a business plan. If you need to get a loan to start your business you will have to have one. It needs to include what your business will be about, what products you will sell, what your expenses will be, what type of profit you plan to make, and also what type of competition are you looking at. This is the best way to decide if it's worth doing at all. Plus you can see realistically what type of overhead you are looking at and what other expenses you'll have. I know of several gift basket shops that seem to do really well in my area. Just make sure you get a tax ID and know the proper ways to deduct all your employees taxes and how to submit them. Also you may want to consider incorporating. This protects you from a lot of personal liability (like if someone ate the soap and got sick and said well you didn't put a warning on there not to eat it). Incorporating only costs around $50 a year and is well worth it.

If you and your sister started out as a DBA, then you wouldn't legally have to do anything, you would use one of your social security numbers. If you decided to incorporate, you would visit your state's website for the correct paperwork to fill out.
